These Terms & Conditions apply to tuition provided by Fatima trading as The Learning Institute, an independent sole-trader tutoring service.

By arranging paid tuition with The Learning Institute, the parent, guardian or other person responsible for arranging tuition agrees to these Terms & Conditions.
1. Tutoring Services
The Learning Institute provides personalised private tuition, currently delivered online.
Current tuition includes:
KS2 Maths, English and Science;
KS3 Maths and Science; and
GCSE Maths, Combined Science and Triple Science subjects.
The subjects and levels offered may change over time.
Unless otherwise agreed, a standard lesson lasts 60 minutes.
2. Parent or Guardian Responsibility
Where the student is under 18, a parent or guardian will normally be the primary person responsible for arranging tuition.
The parent or guardian is responsible for providing information reasonably necessary to arrange and deliver tuition and for informing The Learning Institute of significant changes relevant to the tutoring arrangement.
Parents should ensure that students are aware of scheduled lessons and have appropriate equipment and internet access for online tuition.
3. Initial Consultation
The Learning Institute may offer a free initial consultation before regular tuition begins.
The purpose of the consultation is to discuss the student's needs, goals, current academic position and proposed tutoring arrangements.
A consultation does not guarantee that tuition will be offered or that a particular lesson time will remain available indefinitely.
4. Lesson Fees
Current standard lesson prices are:
KS2 — £25 per 60-minute lesson
KS3 — £28 per 60-minute lesson
GCSE — £30 per 60-minute lesson
Any different fee agreed individually with an existing family will apply to that family's tuition as agreed.
There is currently no joining fee and no requirement to purchase a long-term tuition package.
5. Payment
Tuition fees are currently paid by bank transfer.
Regular tuition may be paid weekly or monthly, as agreed.
Unless otherwise agreed, payment for a lesson must be received in advance and no later than 24 hours before the scheduled lesson.
Where monthly payment is agreed, payment arrangements and the lessons covered will be communicated to the parent or guardian.
The Learning Institute may pause future tuition where payment remains outstanding.
6. Regular Lesson Times
A regular weekly lesson time may be agreed where availability permits.
The Learning Institute will make reasonable efforts to maintain an agreed regular time but cannot guarantee that a particular time will remain available indefinitely.
Where a permanent timetable change is required, reasonable notice will be provided where practicable.
7. Cancellation or Rescheduling by the Student
Parents or guardians should provide as much notice as reasonably possible if a student cannot attend.
Where at least 24 hours' notice is provided, The Learning Institute will normally allow the affected lesson to be rearranged, credited or otherwise dealt with as agreed with the family, subject to reasonable availability.
Where less than 24 hours' notice is provided, the full lesson fee will normally remain payable because the reserved teaching time may not reasonably be capable of being filled at short notice.
The Learning Institute will consider exceptional circumstances reasonably and may exercise discretion where appropriate.
Nothing in this section limits any statutory rights that cannot lawfully be excluded.
8. Missed Lessons / No-Shows
If a student does not attend a scheduled lesson without appropriate notice, the lesson will normally remain fully chargeable.
The tutor will make reasonable efforts to establish whether the student is experiencing a simple joining or technical problem where appropriate.
A missed lesson does not automatically entitle the student to replacement teaching time.
9. Student Lateness
Students should join lessons at the scheduled time.
If a student arrives late, the lesson will ordinarily still finish at the originally scheduled finishing time.
The tutor is not normally required to extend the lesson or provide replacement time for teaching time lost because of student lateness.
10. Tutor Lateness
If the tutor is late and teaching time is lost as a result, the lost teaching time will be made up or another reasonable arrangement will be offered.
Students will not be charged for teaching time that The Learning Institute fails to provide because of tutor lateness.
11. Cancellation by The Learning Institute
Occasionally, illness, emergency or another unavoidable circumstance may require The Learning Institute to cancel or rearrange a lesson.
Where The Learning Institute cancels a paid lesson, the parent or guardian will be offered an appropriate alternative, such as:
rearranging the lesson;
receiving a credit towards another lesson; or
receiving a refund for the affected lesson where appropriate.
The Learning Institute will provide as much notice as reasonably practicable.
12. Technical Problems
Online tuition depends upon suitable technology and internet access.
If a significant technical problem caused by the tutor or The Learning Institute's systems prevents meaningful teaching from taking place, reasonable arrangements will be made to restore lost teaching time, rearrange the affected teaching or provide an appropriate credit/refund where necessary.
If a technical problem arises from the student's device, internet connection or environment, reasonable attempts will be made to reconnect or continue the lesson.
Where the tutor remains available and able to teach, the lesson will normally remain chargeable.
Each situation may be considered reasonably according to its circumstances.
13. Online Lesson Platforms
Lessons are ordinarily delivered through Google Meet.
Scribble Together may be used as an interactive whiteboard.
Students and families must not deliberately share private lesson or whiteboard links with unauthorised individuals.
Alternative technology may be used where reasonably necessary.
14. Cameras and Recording
Students are not routinely required to have their camera switched on.
Lessons are not routinely recorded.
Neither the tutor nor the student/family should record a lesson or make unnecessary photographs, video recordings or screenshots of another participant without prior agreement and an appropriate reason.
15. Homework and Independent Work
Homework, revision tasks or other independent work may be provided where appropriate.
Students are encouraged to complete agreed work because regular independent practice may support progress.
However, responsibility for completing homework ultimately remains with the student and, where appropriate, their parent or guardian.
The Learning Institute cannot be responsible for academic consequences resulting from a student's failure to complete recommended work.
16. Academic Progress and Results
The Learning Institute aims to provide high-quality, personalised tuition designed to improve understanding, confidence and academic performance.
However, specific grades, examination results, school placements or other academic outcomes cannot be guaranteed.
Academic outcomes can depend upon many factors outside the tutor's control, including attendance, independent study, school teaching, examination performance and student engagement.
17. Educational Resources
Worksheets, lesson materials, explanations, whiteboard content and other resources supplied by The Learning Institute are intended for the student's personal educational use unless otherwise stated.
Materials created by The Learning Institute must not be sold, commercially distributed, uploaded publicly or represented as another person's work without permission.
Third-party resources remain subject to the rights and terms of their respective owners.
18. Behaviour and Respect
Students, parents and the tutor are expected to communicate respectfully.
Abusive, threatening, discriminatory, sexually inappropriate, harassing or otherwise seriously inappropriate behaviour will not be accepted.
Depending on the circumstances, The Learning Institute may:
address the behaviour;
end a lesson;
involve the parent or guardian;
suspend tuition;
terminate the tutoring arrangement; or
take safeguarding or other appropriate action.
19. Safeguarding
The welfare of children and young people is a priority.
Tuition is provided subject to The Learning Institute's Safeguarding & Child Protection Policy, Online Tutoring Safety Policy and Communication & Professional Boundaries Policy.
Where a safeguarding concern arises, safeguarding responsibilities may take precedence over ordinary confidentiality or administrative arrangements.
Appropriate information may be recorded or shared where reasonably necessary for safeguarding or legal purposes.
20. Personal Information
Personal information will be handled in accordance with The Learning Institute's Privacy Notice and applicable data-protection requirements.
Parents and guardians should avoid providing unnecessary sensitive information.
21. Ending Regular Tuition
Either the parent/guardian or The Learning Institute may end regular tuition.
Where a family wishes to end an ongoing regular tutoring arrangement, 14 days' notice should normally be provided.
The Learning Institute will similarly aim to provide reasonable notice where it decides to end regular tuition.
Immediate termination or suspension may be appropriate in exceptional circumstances, including serious inappropriate behaviour, safeguarding concerns, persistent non-payment or another serious breakdown of the tutoring relationship.
This section does not affect statutory cancellation or termination rights.
22. Changes to Lesson Prices
The Learning Institute may review lesson prices from time to time.
Existing regular families will be given reasonable advance notice before a new standard price applies to their future tuition.
A price change will not retrospectively alter the cost of lessons already paid for.
23. Consumer Cancellation Rights
Where a tutoring arrangement is entered into at a distance, such as online or by email, the customer may have statutory cancellation rights under UK consumer law.
Where the law provides a 14-day cancellation period, the customer may cancel the relevant contract within that period in accordance with their statutory rights.
If the customer expressly asks for tuition to begin during an applicable statutory cancellation period, they may be required to pay a proportionate amount for services that have already been supplied before cancellation, where permitted by law.
Where a service has been fully performed during the cancellation period following the customer's express request and acknowledgement as required by law, the statutory right to cancel may be affected.
Nothing in these Terms & Conditions removes or restricts consumer rights that cannot lawfully be excluded.
24. Refunds
Where a refund is legally required, it will be provided in accordance with applicable consumer law.
Refunds may also be offered where provided for elsewhere in these Terms or where The Learning Institute considers this an appropriate resolution.
Any refund will normally be returned using an appropriate method agreed with the customer.
25. Complaints and Concerns
If a parent, guardian or student has a concern about tuition, they are encouraged to raise it promptly so that it can be considered and, where possible, resolved.

Safeguarding concerns will be handled under the safeguarding procedures rather than treated solely as ordinary customer-service complaints.
Nothing prevents a person from contacting an appropriate external authority where they are entitled to do so.
26. Liability
The Learning Institute will provide tutoring services with reasonable care and skill.
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot legally be excluded under consumer protection law.
The Learning Institute is not responsible for losses caused by circumstances outside its reasonable control except where the law provides otherwise.
27. Changes to These Terms
These Terms & Conditions may be updated where reasonably necessary, including where services, prices, technology, business arrangements or legal requirements change.
Changes will not retrospectively alter rights relating to services already purchased where doing so would be unfair or unlawful.
Existing regular families will be informed of material changes where appropriate.
28. Governing Law
These Terms & Conditions are governed by the applicable laws of England and Wales.
Customers retain any mandatory consumer rights concerning jurisdiction or applicable law.
